Terms of service

OBJECT.

Unless otherwise provided by mandatory legal provisions, these general terms and conditions apply to all activities of LAETITIA's INTERIORS. These general terms and conditions, as well as any specific conditions of LAETITIA's INTERIORS, are deemed accepted by its buyers and suppliers, even if they contradict their own general or specific terms and conditions.

ADVERTISING.
Since the pots are handcrafted, traces of sponges, irregularities in the glaze, roughness, or scratches are not considered defects but are an integral part of the pottery. Similarly, each pot is a unique model; therefore, all photographs of the products displayed on the website or in printed materials are for illustration purposes only and do not have contractual value.


ORDER.
Orders are final once the order form has been signed by the customer and a deposit of 50% of the total amount (including VAT) has been paid. The order amount is always established excluding delivery costs, which will be invoiced separately. The balance of the order must be paid no later than 7 days before delivery to the final address provided by the customer during the order. LAETITIA's INTERIORS is relieved of any responsibility for failure to execute the order due to force majeure, strike, lock-out, etc.


DELIVERY.
Delivery times are provided as an estimate. Goods are imported from France under the responsibility of LAETITIA’s INTERIORS until they arrive at their storage location in Australia. Delivery to the final address provided by the customer during the order is carried out by the service provider designated by LAETITIA's INTERIORS. The transfer of risks to the customer occurs as soon as the goods are handed over to the carrier, who will deliver the goods to the customer. Therefore, the goods travel at the customer's risk from the warehouse to the final destination, as well as in the case of shipping or returns made with shipping costs paid by the customer. During the withdrawal period, the customer is responsible for the goods as their guardian. In the event of damage or destruction of the product while under the customer’s care, the customer will bear all
consequences. LAETITIA's INTERIORS' liability is limited to the replacement of the defective item, and it will not be liable for any refund, compensation, or damages for any reason. LAETITIA's INTERIORS reserves the right to invoice goods progressively with each delivery, even if partial. Products are delivered to the address provided by the customer on the order form, subject to accessibility and the presence of a responsible person to receive them. If the address is inaccessible to the carrier, additional fees will be charged for a second delivery. Products, packaged on pallets, are dropped off on the street in front of the house or building. Due to their bulk, it is advisable to have assistance for unpacking. The carrier is not authorized to unpack or install the products. For specific deliveries (e.g., to higher floors, mountain locations, restricted access, pedestrian streets, crane truck), additional charges will be billed to the buyer.


PAYMENT.
Unless otherwise agreed in writing, all invoices from LAETITIA's INTERIORS are payable by bank transfer to the account specified on the order form and invoice, according to the terms and due dates indicated. Delivery costs are charged to the customer and must be paid no later than the day of delivery. Failure to pay an invoice by the due date immediately makes all outstanding amounts payable, regardless of any previously agreed payment terms. If payment is not made by the due date for a partial supply, LAETITIA's INTERIORS reserves the right to cancel the balance of the order. If payment is not made by the due date for an invoice, the debtor agrees to pay a late fee of 15% of the remaining amount (including VAT) per day of delay, with a minimum fee of 200.00 AUD. The buyer acknowledges that the goods remain the property of LAETITIA’s INTERIORS until full payment of the invoice and any associated charges, in the event of non-payment by the due date.


DISPUTES.
In case of a dispute, other than for the recovery of unpaid invoices, the parties agree to first resort to mediation by appointing an accredited mediator and to participate in at least two sessions of two hours each in an attempt to find an amicable solution. Disputes shall be under the exclusive jurisdiction of the courts in the judicial district of Noosa Heads 4567, QLD.
